Service and Filing of Pleadings and Other Papers

“Except as otherwise provided in these rules, every order required by its terms to be served, every pleading subsequent to the original complaint unless the court otherwise orders because of numerous defendants, every paper relating to discovery required to be served upon a party unless the court otherwise orders, every written motion other than one which may be heard ex parte, and every written notice, appearance, demand, offer of judgment, designation of record on appeal, and similar paper shall be served upon each of the parties. No service need be made on parties in default for failure to appear except that pleadings asserting new or additional claims for relief against them shall be served upon them in the manner provided for service of summons in Rule 4.”  C.R.C.P. 5(a).

Court Appointed Counsel

To apply for court appointed counsel you need to fill out a Court Appointed Counsel Application and submit proof of income, or lack of income, for your household. Applications and supporting documents should be filed with the specific Colorado Municipal Court as soon as possible to ensure proper preparation and legal representation.

Failure to submit the required Court Appointed Counsel Application and supporting documents in a complete and timely manner may result in the denial of court appointed counsel.

Note:  Please note the specific Colorado Municipal Court location on the application (usually under “County”).  Some Colorado Municipal Courts may have applications specific to their court in addition to the applications listed above.

Where to File:

Submit your applications for court appointed counsel in the specific Colorado Municipal Court where your case is filed.

Note:  The Office of the Colorado State Public Defender represents individuals in the county and district courts of the Colorado Courts and not the Colorado Municipal Courts.  Do not file an application for court appointed counsel for your Colorado Municipal Court case with the Office of the Colorado State Public Defender.

Sealing of Records – Expungement of Records

Any person in interest (party to the case) may petition the Court to seal records by filing a Petition to Seal Records in in which any arrest or criminal record is filed. To seal a record requires that either:
1. the terms of a deferred prosecution, deferred sentence, or conditional motion to dismiss have been successfully completed;
2. conviction was entered by the court for the charge of Minor in Possession of Alcohol and/or Marijuana and the defendant has not been arrested for, charged with, or convicted of any felony, misdemeanor, petty offense, or municipal ordinance violation during the period of one year following the date of conviction;
3.  the case was dismissed by the prosecution; or
4. the defendant was found not guilty at trial.

There is an administrative cost of $65 to seal records.

Under the Colorado Children’s Code, a person may request their juvenile record be expunged (sealed from public access) by filing a Petition for Expungement of Records in which any arrest or criminal record is filed.

Sealing of Criminal Conviction Records

A Defendant may petition the District Court to seal any conviction records, except basic identifying information, pertaining to the defendant for a Municipal violation by filing a civil action in the civil action in the county which the conviction record is located.

1. The Petition is filed three or more years after the date of final disposition of all criminal proceedings against the you or the release of your release from supervision concerning a criminal conviction, whichever is later; and
2. You have no been charged or convicted of a felony, misdemeanor, or misdemeanor traffic offense in the three or more years since the date of the final disposition of all criminal proceedings against you or the date of your release of supervision; and
3. The case you are requesting be sealed contains at least one charge that is not a class 1 misdemeanor traffic offense, class 2 misdemeanor traffic offense, class A traffic infraction, or class B traffic infraction; and
4. Your case does not include a deferred judgement and sentence concerning the holder of a commercial driver’s license or the operator of a commercial motor vehicle pursuant to § 42-2-402, C.R.S., or an offense for which the factual basis involved unlawful sexual behavior pursuant to § 16-22-102(9), C.R.S.
